I am a new supermarket manager, my contract says 39 hours yet I constantly work overtime and work about 45 hours a week. I used to get paid lieu for the first month but this month I am told that overtime is not paid out unless authorised by someone that you are staying behind to help out.

I queried this and got the reply “My apologies for the confusion but we shouldn’t be paying out management ot as we have been.” I asked if it goes into lieu and got the reply “No not unless it’s been agreed.”

So does that mean that I can just walk out at my time, I got told it’s because the “needs of the business” but it’s not my fault they are understaffed. This has really upset me as I’ve been staying behind all of this time and not getting paid for any of it.

Is this illegal or what can be done about this?
