Got busted for pushing motorbike without helmet. How fair is that?

Motorbike broke down. I’m pushing it home on a hot day. Cop pulls over and tells me I have to wear a crash hat because I’m “in charge of a motor vehicle”. I said does that mean people pushing a car have to wear a seatbelt? Cop not amused
